The Library will comply with all requirements of the Fair Labor Standards Act (FLSA).

In certain circumstances, when Library operations cannot be fulfilled during regular working hours by staff, employees may be required to work in excess of normal working hours. When possible, advance notification of these assignments will be provided. Any changes to an employee’s work schedule must be authorized by an immediate supervisor.

Per the FLSA, “Covered nonexempt employees must receive overtime pay for hours worked over 40 per workweek (any fixed and regularly recurring period of 168 hours – seven consecutive 24-hour periods) at a rate not less than one and one-half times the regular rate of pay.”

Under FLSA guidelines, “employees of State or local government agencies may receive compensatory time off…instead of cash overtime pay.” 

Overtime work is based on the employee’s regular work week. Library employees earning overtime will receive compensatory time in accordance with guidelines established by FLSA.

  • Any work performed in excess of the employee’s regularly scheduled work week that is less than 40 hours will be compensated at the rate of accrual.
  • Any work performed in excess of 40 hours per week will be compensated at a rate of 1.5 times the rate of accrual. 

    Example: An employee is scheduled to regularly work 37.5 hours per week and works 38 hours the first week and 41 the next. The employee will receive .5 hours compensatory time for the first week. For the second week, the employee will receive 4 hours compensatory time: 40-37.5 = 2.5 + (1 X 1.5) = 4. 

Compensatory time will be provided to the employee in quarter hour (15 minute) increments. 

Calculations to determine an employee’s allocation of compensatory time will be based on the employee’s calendar month overtime totals. Once all compensatory time (in 15 minute/.25 increments) has been awarded, any overtime remaining that is less than one quarter hour (15 minutes/.25) will be saved and added to the next calendar month’s overtime totals. 

Example:

Overtime worked week 1   =    .09 

Overtime worked week 2   =    .07 

Overtime worked week 3   =    .10 

Overtime worked week 4   =       0 

 

Total monthly overtime                                         =    .26 

Total compensatory time awarded                     =    .25 or 15 minutes

Compensatory time saved for employee          =     .01 (added to the next month’s overtime)

 

Compensatory time will be applied first for any personal leave requests. 

Compensatory time is managed under the same guidelines as the Personal Leave Policy. Any unused compensatory time at the time of employment termination will be paid as overtime pay in the employee’s final payroll.
